SayIt.Now is a service operated by Peakstone Ltd, trading as SayIt.Now ("we", "us", "our"). By accessing or using SayIt.Now, you ("you", "your", "Subscriber") agree to be bound by these Terms of Service.

If you do not agree to these Terms, you must not use the service.

1. Use of the Service

You may use SayIt.Now only if you are legally able to enter into a binding contract and are not prohibited from using the service under applicable law.

When registering, you must provide accurate and up-to-date information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You are solely responsible for all content submitted, collected, stored, or processed through your account, including feedback submissions, screenshots, and any personal data contained within them.

You must notify us promptly of any unauthorised use of your account or security breach. We are not responsible for any loss or damage resulting from your failure to secure your account or provide accurate information.

2. Acceptable Use

You agree not to use SayIt.Now in any way that:

  • Interferes with or disrupts the service or its infrastructure
  • Harms, abuses, or infringes upon the rights of others
  • Violates applicable laws or regulations
  • Attempts to gain unauthorised access to systems, data, or accounts

You are responsible for the conduct of anyone accessing the service under your account.

3. Prohibited Activities

The following activities are prohibited and may result in immediate suspension or termination of your account without refund:

  • Misuse of system resources, including excessive or abusive use that degrades service performance
  • Use of the service to distribute unlawful, infringing, harmful, or deceptive content
  • Attempting to bypass security measures or access data not intended for you
  • Providing false or fraudulent information, including payment details
  • Using the service to engage in harassment, abuse, or illegal activity

We reserve the right to investigate suspected violations and take appropriate action.

4. Billing and Payment

Paid subscriptions are billed in advance on a monthly, annual, or other agreed basis.

You authorise us to charge your selected payment method for all applicable fees. Payments are due upon invoicing. Accounts may be suspended if payment remains outstanding for more than 10 days.

We may change pricing prospectively with reasonable notice. Price changes will not apply retroactively.

All fees are non-refundable unless otherwise agreed by us in writing. We are not responsible for bank fees, currency conversion fees, or charges imposed by your payment provider.

5. Support

Support is provided on a reasonable, best-effort basis via email or support ticketing.

We provide support for issues relating directly to the operation and availability of SayIt.Now. We do not provide support for third-party systems, integrations, customer-specific implementations, or your own customers.

Enhanced or non-standard support may be offered at our discretion and may be subject to additional fees.

6. Suspension and Termination

We may suspend or terminate your access to SayIt.Now if we reasonably believe you have breached these Terms, misused the service, or where required by law.

Where possible, we will make reasonable efforts to notify you and minimise service disruption. In cases involving serious or unlawful activity, suspension or termination may occur without prior notice.

You may cancel your subscription at any time via your account billing settings. Cancellation will take effect at the end of your current billing period.

If we terminate your account without cause, we will provide reasonable notice where practicable.

7. Data and Backups

While we take reasonable measures to protect data stored within SayIt.Now, you are responsible for maintaining your own backups of any data you consider important.

We do not guarantee the availability, accuracy, or recoverability of any data, and we are not liable for data loss except where required by law.

8. Legal Disclosure

You agree that we may disclose account information, usage data, and related details where required to comply with a valid legal request, court order, or applicable law.

We may also suspend or terminate services in connection with such disclosures.

9. Disclaimer of Warranties

SayIt.Now is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied.

We do not guarantee that the service will be uninterrupted, error-free, or suitable for your specific use case.

10. Indemnification

You agree to indemnify and hold harmless Peakstone Ltd from any claims, damages, losses, liabilities, and legal costs arising from your use of the service, your content, or your violation of these Terms.

11. Notices

We may provide notices to you via email, through the service, or by posting updates on the SayIt.Now website.

12. Entire Agreement

These Terms constitute the entire agreement between you and Peakstone Ltd regarding the use of SayIt.Now and supersede any prior agreements.

Your use of the service is also subject to our Privacy Policy, which is incorporated by reference.

13. Governing Law

These Terms are governed by the laws of England and Wales. You agree to submit to the exclusive jurisdiction of the courts of England and Wales.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

15. Limitation Period

Any claim arising out of or relating to these Terms or the use of the service must be brought within one (1) year of the event giving rise to the claim, where permitted by law.
